Terms of Service

Plain-language summary: You're subscribing to a dedicated cloud server (OBS + auto scene-switching + bonded ingest) that we provision and manage for you. Pay through PayPal, use it for lawful streaming, and either of us can end the subscription — you by canceling, us if it's being misused. We do our best to keep things running but can't promise perfect uptime, since we depend on third-party cloud infrastructure.

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and irestream ("irestream", "we", "us") governing your use of irestream.com, app.irestream.com, srtla.irestream.com, and the streaming infrastructure service provisioned through them (together, the "Service"). By creating an account or subscribing, you agree to these Terms. If you don't agree, don't use the Service.

2. What the Service is

irestream provisions a dedicated cloud server for each subscriber, running a cloud-based OBS instance with automatic scene switching (NOALBS) and a bonded SRT/SRTLA ingest receiver, so you can maintain a more resilient live stream than a typical single-connection setup. You manage your server (starting/stopping your stream, setting your destination and ingest URLs) through your dashboard at app.irestream.com.

3. Eligibility and your account

You must be legally able to enter into a binding contract in your jurisdiction to use the Service (generally, an adult by local law).
You're responsible for maintaining the security of your Google account used to sign in, and for all activity under your irestream account.
You agree to provide accurate information and to keep your account information current.

4. Subscriptions and billing

Subscriptions are billed through PayPal on the cadence shown at checkout (monthly, recurring, or a one-time weekly charge that does not auto-renew, depending on the plan selected).
Prices are as listed on the Service at the time of purchase and may change for future billing periods with notice.
You can cancel a recurring subscription at any time; your server remains available through the end of your current paid period, after which it is destroyed.
Refunds are handled case-by-case — contact wappyflanker@gmail.com if you believe you're owed one. We don't guarantee refunds for partial billing periods.

5. Acceptable use

You agree not to use the Service to:

Stream, host, or transmit content that's illegal, infringes someone else's rights, or violates the terms of the destination platform you're streaming to (e.g. Kick's own Terms of Service)
Attempt to access another customer's server, account, or data
Use the dedicated server's compute/GPU/bandwidth for anything unrelated to operating your own live stream (e.g. running unrelated workloads, mining, or reselling access)
Interfere with or attempt to disrupt the Service's infrastructure or other customers' use of it

We may suspend or terminate a server or account that violates this section, with or without notice depending on severity.

6. Service availability

We work to keep your server available and streaming reliably, but the Service depends on third-party cloud infrastructure providers (currently Hetzner and Vultr) and third-party platforms (like Kick) that are outside our control. We don't guarantee uninterrupted or error-free service, and we don't currently offer a formal uptime SLA or service credits. We'll do our best to resolve outages promptly.

7. Your content

You retain all rights to the video, audio, and other content you stream through the Service. You're solely responsible for that content and for having the rights to stream it. We don't monitor, edit, or claim ownership of your stream content.

8. Termination

You may cancel your subscription at any time from your dashboard or by contacting us. We may suspend or terminate your access for violating these Terms, non-payment, or if we discontinue the Service, with notice where reasonably possible. Upon termination, your dedicated server and its data are destroyed; see our Privacy Policy for what happens to your account records afterward.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, irestream is not liable for any indirect, incidental, special, or consequential damages (including lost streams, lost revenue, or lost viewers) arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
